Haryana’s Department of Town and Country Planning May Demolish illegal Floors

The Department of Town and Country Planning (DTCP) of the Haryana government has issued directives threatening to destroy and revoke the occupancy certificates of any unlawfully constructed fourth stories of houses built on residential plots. According to officials, the directive is applicable in situations where such floors have been constructed without the department’s necessary clearance of the construction plans.

All new permissions for “stilt plus four floors” building plans for residential plots, including those that were still pending and had already been filed for approval, were suspended by the Haryana government in February 2023. The question of whether to permit stilt-plus-four-story buildings throughout the state has not yet been decided by the administration.

Although the government has not yet made a decision on the topic, officials stated that the department received complaints about illegal construction of fourth floors in multiple locations, which prompted the issuance of the current orders.
