UP RERA Sets Format For Possession Letters To Flat Buyers
The UP RERA announced on Saturday that it has made a model version of the offer of possession letter available on its website in an effort to stop promoters from acting arbitrarily when sending these letters to flat buyers and to end the conflicts that result from this.
The promoters would provide the allottees with an offer of possession in the same format as it is published on the portal, according to a May 29 ruling that the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) recalled.According to a statement from the UP RERA, project promoters were also instructed not to impose any legally enforceable conditions on the allottees through the offer of possession letter.
The promoters use the name and language of a “offer of possession,” which confuses the allottees and contains some binding conditions, in their “final demand letter” and “final demand notice.” The sole intent behind a “offer of possession” should be to take possession, according to UP RERA Chairman Sanjay Bhoosreddy. Therefore, any alternative letter format will not be accepted; instead, we have provided a sample “Offer of Possession” on the web.
This will clear up any misunderstandings among the parties involved and assist in resolving any conflicts that may arise,” Bhoosreddy continued.The promoter will send the offer of possession letters to the allottees in writing to their registered email address and residential address by post after receiving the OC/CC (occupancy certificate/completion certificate) of the project, the UP RERA stated. They will also receive an SMS on their respective phone numbers and mobile numbers. “In this context, the promoter ought to exhibit data both at the project location and at its headquarters,” RERA stated.
