In a First, Uttar Pradesh Real Estate Regulator Penalises Buyer for ‘Misuse of Process of Law’

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) fined a buyer on Tuesday for “misusing the process of law” in the first instance of this kind.According to the statement, the allottee had submitted a claim for compensation for the unit’s registration delay for the fourth time.

In a commercial project located in Noida Extension, the unit has already been given to the allottee. This is the first time a buyer has been penalized for “misusing the process of law,” a UP RERA official told PTI.

According to an official statement, UP RERA Chairman Sanjay Bhoosreddy strongly objected to the fourth complaint and fined him Rs 5,000.”UP RERA is continuously imparting justice to the large number of allottees who have filed complaints with it, instances of some allottees filing repeated complaints in the same matter and thus misusing the process of law, are also surfacing,” it stated.

The “allottee had not approached RERA with clean hands, that he was misusing the process of law and wasting the precious time of the Bench,” observed the chairman of the UP RERA NCR bench.
