Project Details in Part-wise Completion or Occupancy Certificates Must Match with Registration Records: UP RERA
Before granting part-wise completion certificates or occupancy certificates, the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has requested that all industrial and housing development agencies accurately identify the components of projects.
The names of the completed towers, blocks, or units mentioned in the part-CC (completion certificates) or part-OC (occupancy certificates) issued by some of the planning authorities, according to the state real estate regulator, do not match the information provided by the promoter to UP RERA at the time of project registration. When the conveyance deed is executed and the unit is turned over to the buyer, “such Part-CC or OC creates doubts in the mind of the homebuyer about the status of completion of his unit or tower,” according to UP RERA.
When granting Part-CC or Part-OC, relevant authorities are required by UP RERA to furnish certain information regarding the towers or blocks, according to an official communication. It stated that these particulars ought to correspond with the names provided in the sale agreement between the promoter and the buyer or when the promoter registered with RERA. Additionally, UP RERA emphasized that awarding temporary CC or OC could negatively impact homeowners and is not permitted under current rules.
In addition to breaking the law, the regulator stated that temporary CCs or OCs may cause significant harm to purchasers who take possession of a property based on them only to have the temporary CC or OC later on, for whatever reason, not approved by the relevant planning authority. UP RERA has directed planning authorities to get marketing names of projects and the number of units from promoters during the application for map sanction in order to prevent mismatches between project names and their blocks or towers.
